Terms of Use
These Terms of Use (“Terms”) govern your use of the WorkProof: Timestamp Camera iOS app (“WorkProof”, “the app”) and the website getworkproof.app, made by Velocity Apps (“we”, “us”). By downloading or using WorkProof you agree to these Terms and to Apple’s Licensed Application End User License Agreement (the “Standard EULA”). If these Terms conflict with the Standard EULA, these Terms apply to the extent permitted.
1. What a stamp shows, and what it doesn’t
WorkProof records what your phone reports. A stamp shows the time, place and weather your device and Apple’s services gave the app at the moment you took the photo. It’s a helpful record, not a guarantee, and not legal advice.
- Stamps can be wrong. The time comes from your device’s clock. The address and coordinates depend on GPS accuracy, which can be off near buildings, trees or indoors, and on Apple’s geocoding, which can return a nearby or outdated address. Weather comes from Apple WeatherKit and describes conditions in the area, not at the exact spot. Without a connection, the stamp uses the last known address and weather. Check each stamp before you rely on it.
- No promise of acceptance. We don’t guarantee that any customer, court, insurer, employer or other party will accept a photo, stamp, fingerprint, code or report as evidence or proof of anything. That decision is theirs.
- Not legal advice. Nothing in the app or on this website is legal, insurance or professional advice. If you’re facing a claim or a dispute, talk to a qualified professional.
- Verify codes. Online checking of photo codes may not be available yet, may be unavailable at times, and may change. A missing or unavailable record doesn’t mean a photo was altered.
2. WorkProof subscription
- Subscription required. Using WorkProof requires an active subscription.
- Free trial. New subscribers to the yearly plan may get a free trial (currently 3 days). Unless you cancel at least 24 hours before the trial ends, the subscription starts and you’re charged the yearly price. Trial eligibility is decided by Apple.
- Price. The price and billing period are shown in the app before you buy, in your local currency (currently $69.99 per year or $19.99 per month in the US). Prices may vary by country. Introductory offers, such as a discounted first year, renew at the regular price shown with the offer unless you cancel. Time-limited offers are available only for the period stated in the app.
- Payment and renewal. Payment is charged to your Apple ID when you confirm the purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and renewal is charged within 24 hours before the period ends.
- Managing and cancelling. Manage or cancel in Settings › [your name] › Subscriptions. Cancelling stops future renewals; access continues until the end of the paid period.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple at reportaproblem.apple.com.
3. Acceptable use
WorkProof is meant to show honestly when and where work was done. You agree not to:
- use the app to misrepresent when or where a photo was taken, for example by changing your device’s clock or time zone, spoofing your location, or presenting a photo as being from a different job, time or place;
- edit, crop out or alter a stamp and present the result as an original WorkProof photo, or create fake records or codes;
- photograph people or private property where you don’t have the right to, or use the app to harass, stalk or surveil anyone;
- use the app for anything unlawful, or to defraud a customer, insurer or anyone else;
- interfere with, overload or try to gain unauthorized access to our servers or verify records;
- copy, modify, reverse engineer or redistribute the app, except as the law allows.
You’re responsible for the photos you take, the notes you add and what you send to others, and for following privacy and recording laws where you work.
4. Your data
Your photos, jobs and reports are stored on your device, as described in our Privacy Policy. You’re responsible for backing up your device and for keeping copies of anything you may need later; we can’t recover photos we never receive. If you delete the app or a job, the photos in it are gone from WorkProof.
5. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use WorkProof on Apple devices you own or control, as permitted by the Standard EULA. You can use the photos and reports you create for any lawful purpose, including your business.
6. Apple services
Addresses, weather and maps come from Apple (including Apple WeatherKit and Apple Maps) and its data partners and are subject to Apple’s terms. Weather data is provided by Apple Weather (data sources). Availability and quality vary by location.
7. Disclaimers
WorkProof is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non-infringement. We don’t warrant that the app, the stamps, the verify service or the website will be accurate, uninterrupted or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Velocity Apps is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on a stamp, photo, code or report, including lost claims, disputes, payments, jobs or data. Our total liability for any claim relating to the app is limited to the amount you paid for WorkProof in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not apply to you in full.
9. Apple
These Terms are between you and Velocity Apps, not Apple. Apple is not responsible for WorkProof or its content, and has no obligation to provide maintenance or support. If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims; we are responsible for those to the extent required by these Terms. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Changes and termination
We may update WorkProof and these Terms. For significant changes we’ll update the date above and let you know in the app. We may suspend access to the verify service for misuse. You can stop using WorkProof at any time by cancelling your subscription and deleting the app.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
